Jameis Winston's accuser files federal lawsuit against Florida State

The complaint filed in court. Some interesting allegations if proved. The accuser's version of what happened is strikingly different from what the media have reported. Among the more interesting allegations to me was that a second woman complained to FSU that he raped her.

The JW defenders have twitter buzzing with innuendos tying his announcement today with the filing of the action. Having chosen to go through the FSU hearing, the accuser had to wait until that proceeding was concluded before the complaint could be prepared.

Hmmmmm! He showed up for that 1st class and did not come back until the mid-term exam? Is this a policy instituted by Jimbo: that you really don't need to go to class?

You noticed that too, lol. In Bowden's final years FSU forfeited 14 wins (including Bama 2007) after 61 athletes got the answers to online exams or had papers written for them. So Jimbo might spin it as he requires that players take their own exams. :)

I'll defer to the attorneys on here, but with Winston soon to have an NFL contract, seems to me that his accuser would want him personally named as an additional party in the lawsuit. Of course, if its a lawsuit based strictly on Title IX, I understand how that might not be possible.

I think Jameis was " encouraged" to go NFL asap... because of Title IX investigation and the pending lawsuit.... I would expect some bad news to come FSU way... and I would assume Braxton Miller is basing his decision on this.. ( I'm just guessing)

I suggest FSU write a massive check. They really don't want this to be looked at by a motivated third party. We all know her life and dignity were sacrificed to keep Winston under center. Remember when we thought Auburn was dirt for paying for Cam? Seems silly now by comparsion.

Hopefully, she and the attorneys representing her will win a $gazillion$. She may not stand a chance if that jury is picked from people in Tallahassee. Attorneys should be asking for the case to be moved to Gainesville or Miami.

Then, the next step will be to take some of that $doe$ from an NFL star in a separate suit.

This is the first time I've heard about a second rape by the FSU QB.

Agreed. Cam is almost saintlike compared to this .... Winston. That is all.

My guess is that the case against FSU is MUCH easier to make than against Shameis. And they have more money.

There are so many "specific" details to this complaint that it is hard for me to imagine how the school and others can just dismiss the charges and get away with it. I'm really surprised TMZ didn't attack this like a dog with a bone. I am really glad this woman continues to fight despite the tremendous hit to her reputation and ability to move forward. It says a lot, to me, that she's willing to sacrifice everything to get some sort of personal resolution.

I would expect FSU to seek a change of venue to the Northern District of Florida (Tallahassee Division). The allegations in the complaint on why Orlando is a proper venue look pretty strong to me and to me FSU would look foolish saying that a fair trial could be had in Tallahassee. Also, the accuser is from a small city between Orlando and Tampa. The accuser is being represented by an Orlando firm with a strong local relationships (as well as out-of-state Title IX specialists). My guess is the court would deny a request for change of venue.

As to why others were not sued, the implied right of action under Title IX is pretty limited as to who can be sued, just as it is under Title VII. My hunch is this merely the first of perhaps several suits the accuser will file, an attempt to establish a beachhead outside Tallahassee. The allegations in the complaint identify several potential individual defendants if her counsel can prove what they have alleged.

Is the family of this young lady rich or are these law firms going to take the case for a winning %? The employees who did not report the incident to the FSU Title IX office should be individually liable. I'm not a lawyer so I just don't know, but it sounds reasonable to me.

It sounds more to me that the whole Athletic Dept and assuredly Jimbo, the enabler, are really in deep you know what. I did read quite a few pages.

Yup..What ticks me off is the fact that should any penalties are handed down to The Criminoles, the one person that caused all of this, won't be punished in the least bit, cause he will be gone & players that did no wrong will suffer from his wrongdoings..And will be punished for Jameis's actions off the football field..I don't like Jimbo & hope he is punished for winning at all cost & playing Jameis no matter the situation..
