The athlete is punished. Either the school or the NCAA punishes the athlete. Until a law like this, the agent or jock-sniffer got zero punishment. That person had nothing to lose and a large amount of money to gain.So it's a crime to entice an athlete to break a rule, but not a crime for the athlete to break a rule? That's like arresting a prostitute and allowing the John to walk. Stupid. How about a little personal responsibility from the athletes? Maybe that's too foreign a concept for today's culture.

The athlete can't be punished if he is no longer a student at a member institution. Also, being suspended by the NCAA and being charged criminally are at two different ends of the spectrum.
