Yes, we are a dumb lot. :/ Especially when we state that "as long as it doesn't interfere with his duties". Which in this case, it does.
But that was said on the first page of the thread as well....it was just ignored.

No, he actually does not. Military personnel have curtailed free speech rights, especially while in uniform.
Plus, someone seeking a security clearance while advocating the violent overthrow of the government of the United States (which communists do), then he cannot get a clearance. An officer who cannot get a clearance is largely useless and can be separated from the service. Since he has been given a free education at tax-payer expense, he could be forced to refund the cost of that education, because he cannot fulfill his service obligation.

Does the CPUSA advocate the violent overthrow of the American government? Don't all Communists advocate violence?

That is just tactical, because openly advocating the violent overthrow of the government will get your organization suppressed and your members arrested. Publicly disavowing violence will allow your organization to continue to operate openly, regardless of what your organization's real intentions are.
There are different flavors of Communists, too. When I was living in the Russian House at the Capstone, one of my housemates was a member of the Revolutionary Communist Party, because the regular Communist Party wasn't radical enough for her.
I'd think wearing a Che t-shirt would indicate that support for anti-government violence.

I don't remember when the CPUSA changed this in their constitution. I agree with you it was designed to take the "heat" off. I was reading about the Smith Act. Advocating overthrow of the government was a criminal offense.

The West Point cadet is a moron.
