From the article:

"The defense has indicated it may call Fulmer as a witness and needs his notes and tapes to “refresh his recollection,” according to court filings. The NCAA materials include records of at least six meetings with Lang’s assistant, Milton Kirk, according to court papers."

True, but what Phulmer is actually saying is that the tape never existed, that he never recorded it. That's what the "disclaimer" in the Knoxville Pravda said when they printed our Indianappolis meeting agenda.

I can't say with 100% assuredly, but it certainly sounds like Phil is neck deep in poo-poo.

This is a no-win situation for Phatlock. If he has the tape he is screwed. If he doesn't produce the tape, he is screwed. Anyway it plays out his goose is cooked.

Excuse me if I'm missing something. I try and keep up with all of this stuff, but HOW is phatlock screwed if he does or does not produce the tape. What do you think is on the tape? I think I've heard that it might be some type of Obstruction of Justice Charge if he lost or destroyed the tape? Is this what you're thinking? Is it likely that a Court would find him guilty of Obstructing Justice? or is that just our hope?

In a nutshell, the situation is:

1. In their official report, the NCAA said that Fulmer taped 90 minutes of the meeting with Tom Culpepper at Thunder Thornton's house in Chattanooga, and that they used the contents of this interview against us.

2. When the Knoxville Pravda published the NCAA report, there was a disclaimer saying that Phil says that he didn't make any such tape.

So.... either

A. He did make a tape, in which case he had damned well better cough it up

-or-

B. Johanigmeier LIED about Phil making the tape.

Therefore, somebody's lying. There's no getting around this fact. Either way, it helps Gallion.

This oughta be an interesting month. Lynn Lang sentencing on the 23rd and Logan Young trial on the 26th.

I looked on the District Court calendar, but I didn't see any other dates for the Logan Young Trial other than April 26th. It says it is the report date.

What does "Report Date" mean? Is that the start date of the trial or some prelim stuff?
 
Predictions:

1. Fulmer won't produce the tape.

2. Rather than hang Johannegmier (sp?) out to dry -- they do after all have ALL the goods on him -- he'll say he made the tape for his own entertainment purposes, and when that ran its course, he destroyed the tape.

3. The NCAA will say, "See, there was a tape, and it's not our fault the maker destroyed it."

4. Fulmer will say, "Gee, I'm awfully sorry. The tape would have made you understand how the axis of evil is really in Tuscaloosa. It's a travesty of justice that I can't prove to you how bad those guys really are."

5. Everybody in the world, outside of Indianapolis and Knoxville, will howl and rant and stomp their feet (me included).

6. Not a blessed thing will change, and the orange will skate once more.

Good news: In the words of Ruby Tewes in Cold Mountain, "God won't let this stand long."

Bad news: What's a short time to God can be a long time here on earth.
