You would have thought after the lawsuit with the Braves lessons would have been learned. At least those look similar. Why you want to sue someone with pockets that deep? Sounds like the UA lawyers needed to take the fam to Disney this year.

Any patent lawyers in the house? Is this just the "aggressive protection of property" motions that the law makes you go through to establish that you are doing your due diligence? Is it an ambulance chase to see if you can get some of that sweet Saudi money in a quick settlement? Both? Neither?

yeah looks gaudy. I would never look at that logo and think Alabama. I don't think anyone would. People have seen me wear my Bama hat and thought Braves.
I once met a guy who moved here from Oregon and said he was surprised at first by how many Braves fans were in the state.

From a design standpoint, there are a lot of similarities to the shape and features of the A. I can't say from a legal standpoint how close they are or what is protected with trademarks. I think it all depends on what features Alabama has protected in their logo designs through the Trademark Office. Just because Alabama uses one logo shape publicly, doesn't mean there aren't a lot more features and designs that have been protected in trademark applications. This defensive type of patenting is common in the patent world where you patent every feature possible around your design to lock out competitors from getting close to your design by if they change a few small features.

What’s weird is that NFL franchises are nowhere near as aggressive at pushing copyright claims as colleges. Hell I’ve seen far more cases in which high school teams ask to use their logos and the nfl teams not only say “yes” but ship them the decals for free. However Ive seen more instances where USF finds out Spanish Fort High School is using their logo and sends them a letter from their lawyers to discontinue it.

Because the NFL realizes the amount of money these people are making is chump change and wouldn't make a fraction of a percentage difference in their bank account. The same is true with the colleges but they for some reason are more aggressive about it.

I mean I get it if you were going after retailers making millions on knock off unlicensed gear outside the stadium but a lot of this costs more to file a complaint over than what is actually being made by the offender.

My guess is universities typically have a bloated legal staff, so they (the unnecessary staff) are constantly looking for ways to justify their jobs.

I work in the intellectual property area some. To maintain copyright, you have to show that you are vigilant about protecting your design/artifact. If you allow use of your artifact, then copyright can being revoked. In some cases, you file these lawsuits just to show you are protecting. Somewhat of the same reason a company like Disney makes a daycare in Demopolis remove paintings of Goofy from the nursery walls. They don't really care if they are being used in that manner, but if you let the daycare use it then it becomes more difficult to show why some Fortune 500 company can't.

In this case, you fight it, and you know you will lose. But it gives you something to cite when another player gets a little too close. This is a low cost effort to show vigilance.
