What’s weird is that NFL franchises are nowhere near as aggressive at pushing copyright claims as colleges. Hell I’ve seen far more cases in which high school teams ask to use their logos and the nfl teams not only say “yes” but ship them the decals for free. However Ive seen more instances where USF finds out Spanish Fort High School is using their logo and sends them a letter from their lawyers to discontinue it.
It all boils down to the organizations lawyers' decision - if it's proved that an organization doesn't work to protect it's trademark, its protection can be revoked. There's no fine line, so again, lawyers decide for each organization.

I think this is too aggressive, but if someone is using unlicensed designs for profit, most orgs are going to act to protect their mark.

Unfortunately, my alma mater has a very poor track record in highly-publicized intellectual property snits. Even when they have (sort of) prevailed, they have often been public relations disasters and/or the University ended up looking like a bully.

And yes, failure to defend your trademark can absolutely result in your being estopped from pursuing infringers at some point.

But I'm betting that the University can more than show that it is diligent just from its efforts pursuing those selling unlicensed and/or counterfeit goods that are actually referencing with the University of Alabama or its athletics programs.
