There's no way the schools can keep up with all of this.

One of the more jarring portions of the guidance is related to these entities, targeting NIL compensation from some third parties, specifically those affiliated with boosters: “The fact that funds are provided by a private source does not relieve a school of its responsibility” for Title IX compliance, it says.

I was expecting Title IX to stir things up regarding schools' revenue sharing. I don't see how it can come into play with 3rd party NIL but pay-for-play from boosters is a grey area. True NIL, like Dr. Pepper paying someone to be in a TV commercial, should be completely independent. Boosters can always say they are paying someone for their NIL.

Where’s the proof? Commercials, billboards, appearances?

I just hope it burns to the ground now. Folks wanted them paid for so long now, and it will be the end of college athletics because of it.

What's going to end up happening is Title IX is going to force so many rules this will end up back at where they were, getting not much of anything. The courts WILL NOT budge in protecting Title IX even to the point of ridiculous. They won't care about the independence of transactions, and will ultimately end up violating the male players' rights to earn money to preserve Title IX. Just watch, this will collapse on itself.

Yup. Is a football player who gets an envelope with $5K in it every week going to report that to the school?

Looks this this simply may reinvigorate the old system of paying players under the table.

I think a good start is to require NIL contracts to be required regardless of what school the athlete is attending. "Fake" NIL will calm down after a few athletes transfer and the booster for a school is still on the hook for paying their NIL deal.

Yeah that’s the most troubling part of this - the DOE & the courts seem to be fighting for control of major college athletics.
Courts don't get to pick their battles though. They just make the rulings on issues brought to them based on applicable laws. It's not like they go looking for stuff to litigate.

The DoEd, on the other hand has significant discretion from a regulatory framework. I get they think they are being 'fair', but the only thing this can possibly do is eliminate more non-revenue generating sports, OR force the full detachment of athletics from college, shutting down all those opportunities for hundreds of kids.

Title IX is now the catch-all 900 lb aggressive octopus with tentacles going everywhere, apparently. I'll not make any other observations at this point.

The easy answer - end women's sports. It will happen now. Has to. They will become club sports.

Or, better yet, end the direct connection between all sports and their universities.
