That's unbelievable. I mean, we throw that term around a lot, but this is literally beyond belief. It's like MN is stuck in the 1940s.

I think the title of the article is misleading.

These help explain a little better about the 3rd degree charge that the prosecutor tried to apply trying to define the victim as "mentally incapacitated" and can still go with 5th degree criminal sexual conduct:

It really bothers me that a woman could drink to the point of passing out and a man could literally do with her unconscious body whatever he wanted without her consent and not be charged with first degree rape.

Sure, we have to be careful that two people who have had a few drinks and decide to have sex can't both be charged with raping the other or some other ridiculous but realistic possibility, but this is beyond the pale. An unconscious person cannot give consent and it doesn't really matter what made them unconscious.

There is not an ounce of logic that was used by this judge. An unconscious person can't consent. It's like we've jumped back to Biblical times and the woman has to show injuries for it to be rape.
