The answer could be a reasonable time limit. Not partial birth, but not outlawed from the moment of conception.. company I work for responded much the same way but also is allowing mid-term changes in insurance plans for those in HMO's that are State regulated in states that impose any sort of ban. Those folks will have the option to switch to a national plan where we are guaranteeing coverage regardless of where you live.
