Trump policies X

We're now the point he wants to kill members of the opposing political party.

But yeah, Hillary was the killer, right?

President Donald Trump on Thursday assailed Democratic lawmakers who told members of U.S. military they must refuse any illegal orders, calling them traitors who should face execution.

A ridiculous over the top reaction but you absolutely cannot have service members refusing direct orders from their superiors. If you are told drug cartels have been declared an enemy by your commander in chief and you are then ordered to fire on them and refuse. That is treason, plain and simple.

You 100% can if they're unlawful.

This is the Calley at My Lai argument made real.

No, it isn't.

You better go back and read Tide-HSV's commentaries on this board on treason.

Therein lies the rub, Who gets to decide the unlawfulness? I'm sure you could find quite a few servicepersons that feel that Israel's occupation of the west bank in unlawful, or that they are sovereign citizens and not subject to our laws, or that they find anything they don't like as unlawful.

Court Marshall, probably, treason no. Treason can only be charged after congressional declaration of war. In all likelihood, the actions against the alleged drug cartel members is illegal.

Article III, Section 3, Clause 1:

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the testimony of two Witnesses to the same overt Act, or on Confession in open Court...

I defer to your legal knowledge. So, instead of treason it would be an act subject to court-martial. I get that there is a big legal difference between the two but the outcome for the disobeying soldier is going to be bad in either scenario and something we cannot allow to happen. Once the chain of command breaks down you no longer have a functioning military.

OK, I'll bite.

Specifically which orders are the Democrats suggesting military service members disobey?
They want to refuse to fire on the "fishing" boats that have drums of narcotics in them and are travelling on known smuggling routes.
