If the mother is not here legally (legal = slaves, native Americans, green cards etc), the child should not become a citizen.

The administration has tried to frame the birthright citizenship around the concept of "domicile".
Essentially, somebody that intends to make the USA a permanent residence and with an allegiance to the country.

Justice Amy Coney Barrett made some great points regarding this.
Slaves were brought to this country illegally, and against their will. They did not want to be here.
But the 14th amendment stated the slaves and their children were citizens of this country.

She expanded that concept to include the victims of human trafficking.
They were brought here against their will just like the slaves.
Are they now citizens of this country like the slaves?

What about kids with no known parents (a/k/a Foundlings)?
How do we determine the "domicile" of the parents of these children?
How do we determine where they were born?
