Clemson has also reached out to the NCAA regarding allegations of tampering against the Rebels, Swinney confirmed. He then further called out the allegations against Ole Miss.

“I am not going to let someone flat out tamper with my program,” Swinney said. “If you tamper with my players, I’m going to turn you in. There’s a lot more I can say, but I’m going to let the NCAA do its job.”

I know there are other lawyers on Tidefans as well ( apologies to the rest of ya!). Is there any other situation involving money you can think of, that has fewer enforceable rules than this NIL transfer portal stuff?

I honestly don’t know how they are enforced at all. By NCAA rules the NIL contracts cannot specifically require you to be enrolled in a specific college or university.

 
Dabo said the kid was enrolled in Clemson, attending classes, and in the offseason training program. At what point does that constitute another transfer? If he enters the portal again, shouldn’t he have to file through Clemson? And shouldn’t the player have to sit out with 2 transfers? Or get a waiver?

Coach Karen should have known the kids intentions when he nor his agent would turn over incriminating texts. It’s ok, he doesn’t need them. I’m sure Pete and his administration were too stupid to not use the university cell phone . A simple FOIA request will produce all the incriminating emails and texts.

I might be wrong, but I would imagine that being in the offseason trading program would indicate that the player is available 😉

The problem with NCAA tampering rules is that the way they are structured they are basically unenforceable. Schools are prohibited from contacting players from other teams unless the player reaches out to them first. That “reach out” is what they really cannot prove or disprove because it’s not structured or defined. In a CFB player world where everyone is connected by far fewer than 6 degrees of Kevin Bacon a “reach out” can be construed from a friend of a friend saying that player “has an interest in transferring here”. At that point, the player has reached out and the school says “prove it” if they get called on it. NCAA doesn’t have the stones to do anything about it.
