Its procedural. You appeal to presiding judge on injunction before you can appeal to higher court.

Well, I hope he pursues it into federal court. I do think a federal question is presented and he has diversity of citizenship. This question of different "stripes" of ex-pros needs examination and the NCAA needs to be forced into consistency...

I’m still surprised the denying judge didn’t ask the NCAA three questions:

1. Why do you not allow former professional players to be eligible?

I’d expect the answer to be something about competitive fairness.

2. How is it that experience in the NBA conflicts with your desire for competitive fairness, but experience in European (or Asian or African) professional leagues does not?

3. Why is your standard for eligibility so subjective? IOW, why does any professional experience at all not disqualify a player?
