Jox is reporting that something may be about to take place concerning the future of Franchione. There is a press conference called for 3pm today. Nothing has been confirmed except for the news conference.

Jox just spoke with Texax A&M and there is not news conference scheduled today. So I guess its just a rumor.

Everything I've read indicates that none of the news outlets know anything about a press conference. I think this is simply wishful thinking on the part of many Aggies.

Remember how many press conferences were supposed to happen at the end of last year?

Here's the straw that will break Fran's back.....the story broke last week by a San Antonio paper that Fran had E-mailed to a select group of boosters and had them pledge secretcy. It seems for $1200 each they would recieve "inside information" on injuries etc.This would benefit gamblers, if they knew certain players would or would not be playing. Fran was to use this ill gotten gain to pay Mike Mckenzie who is handling Fran's webb site and susposedly writing a book about Franny.

Coach Stallings said also "what about the IRS!" Coach Stallings is on the board of "Regents" at A&M. Who knows, Fran may have to turn loose the rope at A&M before the season is over.

I think this whole charging for an email business is a non-story that is being brought up because aTm wants to get rid of the guy. They need more ammo than just subpar play.

Classic case of not getting what they paid for, 5 years ago. Hmmmm...I hope we're not saying the same thing 3-4 years from now.

The issue here won't be the IRS - it will be HIPAA. What Franchione did by disclosing medical information about his players was to violate the federal act that was designed to protect patient's privacy and medical records. This is the same law the prohibits in-game medical updates from coaches or team doctors. Only the player or is allowed to tell the media anything about his condition other than what can be observed (but not OVERHEARD, just observed - e.g. saying that Prothro had a broken leg since it was obvious).

I will say this - if he was a doctor at the A&M Student Health center and did this he'd already be fired.

RT3413, it's actually not that cut-n-dried - the player can (and often does) sign a waiver allowing the staff to discuss injuries if they feel it's beneficial to do so. IOW, there's no way of telling if fRan violated any HIPPA regulations by what he shared without knowing which athletes he spoke about and whether or not they sign HIPPA waivers.

It's much ado about nothing, IMO, but it's more bad press and it's really made the A&M folks vocal about wanting to get rid of him. If they can get him on a contractual clause, such as doing something that makes the university look bad, they can save about $6.3million in his buyout - that's what most of this is about, imo...

My theory is that an aTm booster leaked this to the press. Makes it easier to fire the weasel when the season is over.

I don't know where JOX is but they are the worst sports radio station. Every time something was posted from them regarding the coaching search it was wrong.

Since It's going to get out anyway I must confess. I was one of the 12 people who signed an oath to never divulge anything Coach Fran, errrr WriterMike stated in the e-mails. $1200 is quite a bargain to set the stage for Fran's undoing. Actually, the information WriterMike sent my way helped fund many activities and seed new businesses within the family.

After sending the the San Antonio Express the e-mail, I went ahead and sent it to my buddies at the IRS and FBI.

Going above and beyond the Witness Protection Program.

With all due respect, I disagree that it's most likely much ado about nothing.

If I'm a disgruntled A&M booster, can I "find" a student-athlete whose medical info was disclosed without proper release forms having been signed? Possibly. Then the HIPAA issue is prescient.

However, if the President and BOT want to get rid of Franchione, they now have their avenue -- the AD has denied knowledge of the newsletter. A&M may have to pay to get rid of Franchione, but they can now make the newsletter and the associated monies an issue because -- loosely interpreted -- running the newsletter outside of A&M auspices might be construed as LOIC, then Franchione has exposed A&M to unnecessary risks, regardless of what HIPAA issues exist or do not.

I do not believe that HIPAA restricts what coaches can, and can not, say about a players playing status. A coach may not be able to discuss a players specific injury or treatment, but he can say whether or not a player will dress on Saturday.

Overall, IMO, this is a VERY stupid thing for coach Fran to do. I imagine a rival coach could easily get the information Fran is providing to the "public". Such information could be very important to a team that aTm is facing on any given Saturday.

It applies to any entity to whom medical info is entrusted. And despite what's been said in this thread, "shotgun" waivers don't count. They must be very, very specific and they must spell out exactly to whom the info is to be released. I'm fairly sure that "secret booster group" was not listed in there with insurance companies and the usual legit recipients. Also, as I've noted in the other long, fat thread on this exact subject, the age of the players is paramount...
