That is why it is illegal to take payment in exchange for dropping criminal charges. But we cannot force victims to testify, nor can we take away a victim's right to sue in civil court.
The DA's office in your area must operate differently than here lol. Once the victim starts back peddling or recanting, it's over.
The State couldn't even use her statements to police at trial. It'd be a violation of the Confrontation Clause (and hearsay); unless JW makes the witness go away (ie kills her) he could (rightfully) argue trying to use her statements without her live testimony is a violation of his constitutional rights. When I see family violence cases, the first thing I always try to figure out is if the victim is going to testify; if they aren't, the DA's office will eventually drop the matter.

Right, but not because they cannot prosecute, but because the cannot win. The state doesn't waste time on cases that it cannot win.

That's the ONLY route the defense -can- take if DNA evidence has been verified. I'm not shocked at all. But at the end of the day, I still say this is going nowhere.

There's article on ESPN main page with the attorney's quotes in it. The DA in the case sounds pretty spineless from his comments in there as well. I suspect the DA's office is going to blame the lack of police investigation when they choose not to bring criminal charges.

He has done the correct thing and not admitted to anything. Force them to come up with the evidence first, and then come up with your story. I have seen no credible report that he has ever made a statement.
Yup, it's the police's job to bring forth evidence to convict you. You have no duty to help them in that regard.

Frankly, I`ll be rather stunned if this isn`t the final outcome.
It looks like Winston has not wasted the time that he has had since he was notified of this by the police back in February. I have no faith at all in the stories that his "witnesses" will tell. They have had months to get it together.
