Matt Baker of the Tampa Bay Times (reporter breaking the recent story) was on sports radio here this morning. When asked about any blow back from the story, he said that he has received death threats, been called a Bama homer, a gator homer and even an Ohio State/Urban Meyer homer. He also said that more will be coming out over the next couple of days and it will be even bigger news.

See, that's the problem - Winston does not have enough money to "buy her off". It would either have to be paid by an agent immediately, or be a promised payment after he signs in the NFL. If an agent pays, that agent would be taking a huge chance - Winston is still 2 full years from being able to play in the NFL. Anything can happen in 2 years - especially if Winston is a person who is of this type of character. Also consider that the agent getting involved would be breaking several laws. Just not likely.

If the girl decides not to press charges for future payment, there could be no written agreement. That agreement would be illegal, and would not hold up in court. So she would just be trusting him to pay her years from now - the guy who raped her. Not Likely.

In other words, I don't see this as the typical "payoff" scenario. I think it goes to court.

Yeah, but many times we don't know people enough to know what they would do when put in a certain circumstance. I'm not saying Winston is guilty but it could be the reason those people say he would never do anything like that is because they never saw him under these circumstances.

No one knows what goes on behind closed doors - no matter how well we think we know someone!

Who from? The TPD. They may have bungled the case, but I think it is a tough arguement to prove in court. JW has no money. You damage his ability to go pro with these acusations so he may not have any future earnings. A booster might pay them off, but as I understand it, the case is in the hands of the state attorney, not the victim or her family so what prpose would that serve. Maybe someone who has legal knowledge can shed some light.

The football part of the equation is interesting. Baylor is just sitting there at 3 with a great shot at a championship if JW get suspended. They still have to beat OSU, but who would have thought they would any shot at the title. If Baylor loses then OSU may or may not slip in against FSU. It is getting crazy.

If the TPD tried to cover it up I don't see how they are not liable.

I know that in some states a rape case or domestic abuse case can be pursued if the evidence is strong even if the victim decides they do not want to pursue it. I am not sure about the law in Florida.

Is it irony that a few weeks ago we were reading about Winston's recruiting experience, specifically about the father turning up the television to make talking difficult. That's arrogance, and without judging, seems to be a trait in the Winston family!

If Winston gets suspended, and unless his replacement QB plays out of his mind, I don't see a scenario where FSU doesn't fall behind Ohio State and Baylor, and if they don't look good on the field then maybe even one of the one-loss teams jumps ahead of them.

Also, since he redshirted last year, do you mean that he would have to wait 1 more academic year before joining the NFL?

Am not aware of deep family pockets - I guess it is possible.

I forgot that he was a resdshirt, so only 18 months to wait (until next year's draft).

I said it the other day and I'll say it again: it's too early to make a judgement either way. You've gotta wait until all the evidence comes out - and that won't be for a long time. I imagine in a few days a lot of people will think Winston is completely innocent again.

It's called "sovereign immunity." You can't sue the state except to the extent the state allows it. And I mean "state" generally. The federal government has allowed it under the Federal Tort Claims Act. I have no idea about FL, but city liability, unless it's been raised is $150K in AL. The officers might be sued for acting outside their authority, but that's generally a dry hole...

There's still more that could come out, but remember he's damaged his credibility badly, with the no sex, then evidence of sexual battery, then the DNA match. I'm not blaming people at all for thinking there's a prima facie case. He's going to need some major revelations or the girl is going to have to drop the matter...

Yes, but that's not really sports related per se. Police departments and prosecutors do immoral, illegal things every day. That's not news to me. It's like hearing about Congress wasting money. Ho hum.

When has a Heisman favorite been suspected of rape in November? On that issue we need to be prudent.
