Right or wrong - generally if a woman reports a rape and is willing to pursue it, she gets her day in court. If something different happens here we will know why.

If this goes to trial the prosecutor is going to present the DNA evidence and call the doctors who examined the victim's bruises on that night to the stand. A jury will be swayed by that far more than a biased witness testimony.

I don't like that one bit. The problem with that is it ignores a team's accomplishments (or failures) potentially. Let's say the media caught wind of GMac having broken ribs, that could have become grounds for at least lowering Alabama's seed.

Likewise, it means you can excuse a loss because ____ got hurt (the Texas excuse), and we all know the loss happened, what we can't know is that the team would have won with Colt or who ever on the field. Really, that year sums up why I do not like considering anything other than the actual results. If a player is hurt, or suspended, so? The game was still won or lost.

Let's assume Winston did this, does that mean the entire FSU team should be penalized? He didn't win all those games by himself, and we can't know how they would have done without him.

You are probably right, but it looks like the defense is ready to start putting this girl on trial in the media.

Yep. TPD "botched" the investigation; I'd be curious to see if the police even interview the witnesses from the affidavits or rely solely on the piece of paper. It's amazing what hours of interrogation do to people to punch holes in their story (if it's fabricated). Any officer involved in the initial investigation should be suspended immediately and charged with obstruction of justice.

I read somewhere that the "witnesses" were other football players. That doesn't make it true, but... we know they're not going to finger Winston if that's the case.

The police down there did everything they did to help Winston get away with it, they intimidated the witness, they didn't go after Winston, and... well I say get away with it without knowing his guilt or innocence, but in truth there's a lot of people acting like he needs help getting away with something. Why involve the campus police? Why give the girl a talking to about going forward? If it's nothing, there's nothing to act on. I'm seeing a lot of smoke...

The only way he goes down at this point would seem to be if there is clear physical evidence of a rape

If I am not mistaken, even if she decided to not press charges, doesnt Florida law require they require the state to continue prosecuting? Kinda like if police are called to a home and they see the woman has bruises from being beaten by a spouse, even if she doesn't want to press charges the state then steps in and prosecutes....

They'll just say it's "rough" consensual sex. Neither JW nor the victim can truly get justice because of the police handling of the crime. JW (if innocent) has had his name drug threw the mud when a complete/thorough initial investigation might've exonerated him without the public knowing. If he did it, then the CW is going to have a tough time getting justice when no investigation was done right after the fact ('witnesses' have had time to memorize (or forget) their stories; physical evidence goes away; etc).

That's what I'm saying. If it's consensual believe me he would have said so in the beginning. But to deny deny deny then oh yeah, we did have sex...

It doesn't make sense.

They are only required continue their investigation until the State's Attorney makes a determination about the case. If they decide that the case is not winnable, they do not have to hand it over to a GJ or prosecute.

It's not viewed the same as domestic violence. If the victim decides to skip the whole deal, it's over.

Florida has done that a couple of times lately: Trayvon Martin and Casey Anthony. They had no chance of winning either.

Just my opinion, but I believe that the evidence that we have read about is sufficient to warrant a trial. If the State Attorney decides not to bring this to trial on his own, the Justice Department should get involved. At a minimum, this should go in front of a Grand Jury.

I think the problem with both is that prosecutors over charged the defendant. The Anthony case was just asinine. They could have convicted her easily of lesser charges and put her away for a long time, but they got greedy. With Zimmerman they would have had hard time convicting him of anything close to murder.

They had no chance in either case. After Casey Anthony's attorneys threw her father under the bus and presented him as a credible perpetrator it was over.

I'm not saying I believe it. I'm just saying what a defense attorney would argue. Or the more basic argument is ... what proof is there that these bruises were from my client and not person A or activity B or whatever. With how shoddy the police work done was, I'd bet they didn't take many, if any, pictures of physical injuries.

Imagine the signs Winston we will see on ESPN Gameday and at games if he is allowed to continue this season.
