You are probably aware that we are prohibited from sharing our opinions of our local judges publicly, 1st Amendment be damned. However, we do share amongst ourselves. There are a lot of people on the bench who probably don't belong there. I tend to agree. I notice that, in WI, "lesser included offenses" is a matter of agreement, rather than being automatic. If I followed correctly, they are now part of the charges, at least in the Huber incident. I think something in the way of manslaughter, whatever their terminology is there, 2nd degree intentional homicide, I think, is appropriate. Sometimes, here the lesser included offenses sometimes lead to verdicts which seem nonsensical, inappropriate to the facts before the jury. What has happened there is the jury doesn't like the cubbyholes in the law and decide to use jury nullification to assess what they feel is the appropriate punishment. Having said that I think manslaughter is appropriate, I think the jury lets him off on self-defense. Hell the SCOTUS has more clerks than a Kevin Smith film. It's amazing how modern tech might as well be black magic in many of their opinions.Does he not have a clerk he could ask for help on things like that?
I remember once a SCOTUS case involved gay rights and one justice (I think he was even seen as a liberal) lamented to his clerk he couldn’t relate to the case because he didn’t know any gay people.
