I think SCOTUS ruling on Presidential Immunity ends the American Experiment

SCOTUS being the final arbiter of what is (and not) immune.

That's it.

That's the only check.

And do you believe the majority of this court would treat them the same?

I don't.

But to be clear, I want NO president to have that kind of power/immunity.

And no one else should want that.

Particularly anyone who claims to love the republic and the rule of law and constitutional separation of powers.

And criminal prosecution?

Under this court that would not even have been a possibility.

That's how absurd this ruling is.

If this ruling had been in place then I think Nixon would have been much more aggressive with his tactics. If I remember correctly, he was using the IRS to target opponents, among other things. No telling what he would have done with this new immunity deal.
He may have been able to bully the Senate to prevent 67 votes to impeach.

Former President Donald Trump amplified posts on social media calling for a televised military tribunal for former Republican Rep. Liz Cheney and the jailing of top elected officials, including President Joe Biden and Vice President Kamala Harris.
“ELIZABETH LYNNE CHENEY IS GUILTY OF TREASON,” one post created by another user that Trump amplified on his social media website Truth Social on Sunday reads. “RETRUTH IF YOU WANT TELEVISED MILITARY TRIBUNALS.”

A separate post Trump amplified on Truth Social Sunday includes photos of 15 former and current elected officials and says, “THEY SHOULD BE GOING TO JAIL ON MONDAY NOT STEVE BANNON!”

Trump, who has been convicted of 34 felony counts and faces an additional 54 charges in three other cases, has long suggested he would try to prosecute his political opponents if he’s elected to a second term.

His suggestions of potentially going after political opponents by weaponizing the Justice Department began more than a year ago, when he was first indicted. Trump has said he would appoint a special prosecutor to investigate Biden and his family if he wins a second term and has argued several times he believes he is justified in doing so because Attorney General Merrick Garland appointed a special counsel to oversee criminal investigations that implicate Trump.

Immune. Immune, immune, immune.

Trump would be immune for all of these core power or official acts if he follows through on his word.

And just the threat is chilling, and chills free speech and legislative independence.

I know people who lack the ability to reason will compare the prosecution of Trump for actual criminal acts to his talk of going after others without any basis in law or evidence to do so, but they are not the same.

The NY case won't be overturned. Everyone is in a panic and Sotomayor didn't help at all. There are three parts to immunity in the decision. The first is absolute immunity. That would be recognizing a country or sending troops to kill a terrorist on foreign soil. There would be many other examples. The next is presumptive immunity. The president can claim immunity, but a prosecutor can show that whatever was done was not under the absolute immunity, and the immunity would be overcome and prosecution would go forward. The NY case would fit this. Trump can claim it, but he can also claim that the sky is green, but neither is true. The last is unofficial duties. Calling an election official in GA and asking him to find votes is in no way an official act and can and should be prosecuted. Taking classified documents he had to no right to take aren't official duties either and the prosecution can and will go forward unless he wins and pardons himself.
