Defining free speech

CLARKSVILLE, Tenn. (WKRN) — Austin Peay State University will pay one of its professors $500,000 after initially firing him for a social media post made in the wake of conservative activist Charlie Kirk’s death.

Darren Michael, an associate professor of acting and directing at APSU, was fired by the institution last year after comments on Kirk’s death. In September, APSU moved Michael to suspension before fully bringing him back into the classroom last month.

The government’s actions “trample on protections the Constitution singles out as essential to legislative independence,” Kelly’s lawyers wrote in the lawsuit, which was also filed against the U.S. Navy Department and its secretary, John Phelan.

“It appears that never in our nation’s history has the Executive Branch imposed military sanctions on a Member of Congress for engaging in disfavored political speech,” the lawyers wrote.

Michigan State University will pay $300,000 in attorneys’ fees and damages to end a lawsuit brought by its own professor against two trustees who called him “racist” for using the term “mob rule.”

The State News obtained a copy of the settlement agreement between Professor Jack Lipton and trustees Dennis Denno and Rema Vassar.

Professor Lipton (pictured, left) sued the trustees after they appeared to have organized a campaign against the neuroscientist for criticizing Vassar’s (pictured, right) allegedly unethical behavior as board chair.

According to the lawsuit, Vassar accepted gifts from a university donor, including traveling on a private jet. She also appeared in an ad endorsing a former trustee’s private wealth management business.

However, she had organized supporters, including sorority sisters, to attend the meeting. In March 2024, Vassar did resign as board chair.

“When any meeting attendee spoke in support of holding Vassar accountable for her actions as outlined in [Trustee Brianna] Scott’s letter, Vassar supporters interrupted and jeered them and attempted to prevent them from completing their statements,” the lawsuit stated.

According to the lawsuit, the trustees worked with student groups “to label Dr. Lipton a racist, publicly attack him in the media, post defamatory letters about him on social media and other public platforms, and file complaints with MSU’s internal civil rights office as well as its external accrediting body accusing Dr. Lipton of race discrimination.”

Free speech lawsuits mount after Charlie Kirk assassination

Five months after the assassination of right-wing activist Charlie Kirk, a wave of lawsuits reveals how Americans were investigated, fired, and in one case, arrested for their online reactions to his death.

The most dramatic case involves Larry Bushart, a retired police officer in Lexington, Tenn. A self-described progressive and "keyboard warrior," he'd been posting memes that mocked Republican officials' mourning over Kirk. Then local police came to his door.

Hello? Kristi Noem?

Robert Reich here. I hear you’re trying to find the names of people who are making negative comments on social media about ICE enforcement.

Look no further. I’ve done it frequently. I’m still doing it. This note to you, which I’m posting on Substack, is another example.

If you want more details, just type “Robert Reich” into an internet browser, followed by YouTube or Facebook or Instagram or X or TikTok or Reddit. Or Substack. Then type in your name, or ICE, or the Department of Homeland Security. That will give you plenty of evidence.

If you read what I’ve said, you’ll find it’s very critical. I’ve done some videos that are very critical of you and ICE, too.

Let me not mince words: I really truly believe you’re doing a [crappy] job.

I’ve said and will continue to say that many of the things you and ICE are doing are unconstitutional.
