This is the first thing I have ever heard about him that is negative. Anything is possible I suppose and I just hope the truth is revealed for all involved. If he is not guilty, I hope the apologies get as much press as the accusations inevitably will.

A local PD and District Attorney can close a case and have it reopened by the State Attorney General. This happened here to a man accused of child molestation. The District Attorney presented the case to a grand jury FIVE times and it got NO BILLED every time for lack of evidence. 2 years AFTER the last GJ failure, in swoops a new Asst. Atty General who decides she is going to reopen this and somehow she manages to get the man indicted with absolutely NO physical evidence and on the word of an ex-wife scorned. The child gave no incriminating evidence in a forensic interview either. It is SICK what can happen to innocent people when you get an over-zealous prosecutor on board. I hope one day she (the atty) gets what is coming to her one day.

The way I read it was that the Tallahassee PD turned the case over to the State Attorneys office today. If that is correct, one would assume they found something... (Earl, thoughts/insight???) Hopefully this isn't a state AG trying to make a name for themselves....

The police report has the suspect between 5'9-5'11 with straight hair. Winston is 6'4 so who knows. Story is developing though and winston is supposed to speak to the media after practice.

Maybe he didn't have sex with the victim but watched/encouraged it. have no idea, but I'm sure someone has ponied up $$$ to make this go away.

I think there is a great deal of credence given to an accuser who immediately contacts the police after an alleged sex crime victimization. I also think the local law enforcement was being very careful and maybe even trying to sweep this under the rug. The reason why this comes out now is probably because the victim is tired of seeing her offender getting idolized and exalted while the police are seemingly trying to avoid action.

Is the State Attorney’s Office involved because it happened on campus or is there another reason?

I believe that in Florida the State's Attorney is what many other states call the District Attorney.

Paul's right. At this point, it will be the prosecutors' decision on whether they have enough proof to take the case to the grand jury or if the investigation will be closed.

One other point, in cases like this there can be all kinds of DNA evidence, but those don't necessarily answer the question of physical force.

Tallahassee is a small town that's been waiting a long time for a return to the spotlight. One can imagine police and DAs treading very carefully here. That said, Florida has the strongest open records laws in the country. Odds are we'll know more sooner than if this had occurred in another place.

As for the alleged offense, it requires proof that the perpetrator penetrated the victim orally, anally, or vaginally.

And, they're thinking that after all this time, the "evidence" might still be there??

I would not assume any new evidence was found. Mark Schlabach reported that TPD only turned this over to the DA after TMZ had contacted them for information on it. Seeing it was about to hit the fan they turned the case over to the DA. The DA is infuriated he knew nothing about it. So now case is being reopened. I would not assume any new evidence was found, but I would assume DA is so angry hes reopening case to take care of it himself. Not rumors, reported by Mark Schlabach on ESPN last night.

I have no idea or knowledge of JW's guilt or innocence, but I do feel sorry for the FSU team and fans right now.

They are in a position to win it all and this will be a huge distraction for all of them.

As for FSU, I heard that their back-up Coker (who is reportedly interested in transferring to Bama next year after his graduation) had season ending surgery a few days ago.

IF JW has to miss playing time this will be a serious blow to their title hopes.

I know nothing about the character of JW. What I have heard is good, and I hope there is no truth to this. What I also have discerned is that he is at FSU, rather that Bama, because he wanted a guaranteed starter position. If you are afraid to compete, I wish you well where ever you land. You don't belong in Tuscaloosa.

I heard this store on Sirius tonight and the first call right after the news was from..... a barner, basically claming this release at this time of the year is an Alabama conspiracy to get AJ the Heisman. Unbelievable, but what would one expect from a barner.

State Attorney Willie Meggs would not confirm that Winston is the subject of the investigation. He told the Miami Herald he did not know why it took 11 months for police to ask his office to get involved in the investigation: "I don't have the answer to that. You'll have to contact the police department."

I know why the SA wasn't contacted. It was the TPD, duh. They don't want any fsu player in trouble. Same thing in Gainesville with the GPD.

Oh, yeah. About 5:15pm yesterday this was reported on Sirius channel 91, college sports. WITHIN SECONDS, a barner called in and launched into a long, involved conspiracy theory demonizing and blaming Bama for this. It was hilarious because he was so serious. We had to pull the car over for safety, we were laughing so hard.
