Most Of Cottrell/Williams Case Thrown Out...

I figured it would not get far. Now its time to move on. Even if this goes to the Alabama Supreme Court, it will be thrown out

I'll take some of that...

I definitely said that most of it would be thrown out because it had nothing to do with their case, but rather the overall dealings of the NCAA with Alabama.

The only information pertinent to Williams and Cottrell were left in as they should have been.

Be interesting to see how the rest of the case plays out and also how the Alabama Supreme Court rules on appeal.

Anyway all the information about underhanded Phats is out in the open and most reasonable people can see what a big cry baby he is and folks have really seen how fair and balanced the NCAA justice system is, so maybe this was not a total loss :)

okay, i'll chime in by saying that the whole situation has left me totally unimpressed with gallion as a lawyer. he had a weak case, did a lot of goofy saber rattling in front of the cameras, and made a fool out of himself with some of the absurd comments he made.

it appears, however, that the defamation portions are not so weak and may actually make it to the jury. that's the only part that ever should have been filed in the first place, but it's pretty clear now that gallion wanted to raise heck, smear the ncaa (which is fine with me), and get his mug all over the camera.

shabby lawyering in my opinion.

I'll tell ya JT, I wish the whole thing would get tossed. There is a lot there that will never see the public eye...and it is something we can all be thankful for.

Not terribly surprising...

Basically the Judge dismissed the more "colorful" claims that really didn't appear to be substantiated by the evidence presented. The conspiracy claims really were a stretch.

The judge allowed the defamation (libel/slander) claims against the NCAA and Culpepper to remain -- which to me seemed like the right ruling given all that we've seen.

Much as Gallion wanted this case to be about Phattumus/Kramer/NCAA, it simply really wasn't. Ever.

I have to disagree. The only thing this did was to give anti-Bama fans more to gloat over. The way this will be looked at by most outside the Bama nation will be as vindication for the NCAA. And of course that's how the NCAA, et al., will spin it.

The only relief from this mess will be time.

I should not be surprised, the NCAA is of course innocent just like Scrushy, Michael, Blake, and OJ.

I love the old saying that "crime expands in relation with society's willingness to put up with it" ..... our society deserves what it gets.

Conspiracy charges are very difficult to prove, and at least in part the judge's ruling was that Gallion was very unlikely to be able to prove the case.

The sad part of this is that Gallion's investigations did expose a lot of corruption and blatant unfairness in the NCAA. Had the full case continued, then there could well be some outcry from people other than the Bama nation for reform of the organization. Now it will continue to be business as usual.

The NCAA didn't have much substance either, but then they didn't have to worry about a burden of proof.

I will never put it behind me.

The Case...

My 2 cents is let it go. Let's get back to kicking some butt on the field, help 'em up, then knock them down the next play and so forth.

That is what will gain our respect back. Nothing else.

So, here is to 2005 being that step in that direction.

Looking forward to another 11 year run on UThug and 20 over Trailer Park Town.
