Nico Johnson arrested

If cops want to arrest you, they can always book you for something. It might not stick, but they can arrest you for it. Just like cops must have a reasonable cause to pull someone over, if they suspect them of having something they shouldn't (pot, drugs, etc.), they can pull the "broken headlight" routine.

For this, assault is the non-physical part of "assault-and-battery". But, once again, I don't know the details, but cops can arrest and book someone for basically whatever they want.

The old "disorderly conduct" charge can darn near be anything. Yell, "disrespect to a police officer", cursing, etc. All those can be disorderly conduct for arrest purposes. But, then you have the DA decide if he is going to push it.
 
I know it'd take all the fun out of popping off and firing from the hip, but, if you guys would read the rest of the thread and the links, you'd find out that absolutely nothing like you're describing. Another kid got mad at Nico and swore out a warrant. When he heard, he went and surrendered without incident. Sorry, no scene like you're imagining...

Even if it is spurious, I'd rather cooler heads in air conditioned rooms figure out what happened between Johnson and the complainant than to have them "solve" the problem on their own late one night in Andalusia.
If it is spurious, it will get tossed and no harm done to Nico other than the inconvenience.
 
Alabama recruit Nico Johnson faces harassment charge
Johnson's brother Michael defended Nico to the Press-Register, saying, "It was another student trying to provoke him, actually. It's just been blown out of proportion. He hasn't done anything wrong."

Those close to Johnson expect the charge will soon be dropped, though a court official confirmed that did not happen by the close of business Friday afternoon. Police interviews have been conducted with the complainant and Johnson.
 
I'm not sure what's going on here, but I don't like it. I've tried time and time again to explain there was no altercation with a cop. The next guy who posts stating or implying it goes on suspension. I'm not going to see our site turned into propaganda for our rivals. Understand?
 
I'm glad no one heard me today on the golf course:mad2: (except the guys i was golfing with), they had some choice words to.:biggrin: WE all would be in prison right now without a trial.:eek2: I hope this all works out for Nico, I think it's going to be ok.
 
He is going to be fine. I call it sour apples. He is going to UA for play for the Tide. Where is the dude going who filed the complaint? Absolutely no where. Nico will be Rolling with the Tide while this person will be playing for BYU. Backyard U!

For all you cop haters out there...

I have had a lot more folks talk themselves into going to jail than the other way around. Some folks don't know when to shut up and listen. Same on here.

Hope Nico comes out OK on this.

TIDE-HSV is right. This is simply a case of two individuals probably having an argument. What usually happens in minor cases like this is that one of the parties goes to the police after the fact and says that the other party assaulted them or something of that nature, and he swears out a warrant. Then, the next day the police will go to the home of the other party and tell them to just come down to the police station on their own to be processed when they get ready, and the charge is some misdemeanor like "harrassment." There is really nothing to this other than that.

Even if the charges are not dropped and Nico is found guilty, the most likely scenario is that he files for youthful offender status, which he will get, and he may have to pay some small fine. The youthful offender status will assure that it doesn't go on his record, and then everyone will go their merry way. This is much ado about nothing.

That kind of depends on where you and your wife were arguing, if it's inside your own house, it's unlikely that the police would take notice, unless it is so loud and prolonged that neighbors call the police. If you are outside or in a public place, police involvement would be much more likely.

As was pointed out above, an assault can be verbal. I think in most cases, those type arrests are for disturbing the peace, rather than assault. I hate to open the Castille can of worms again, but if you read the statute/ordinance, yelling, arguing, screaming, etc. in a public place qualifies as "disturbing the peace." The law does not provide any exceptions for "boys will be boys" or "we were just kidding around." The person might not get convicted for these reasons, but the police only enforce the law as written, it's not their position to interpret it.

Plus, the impression I got from the description, "harrassment, after a verbal, non-physical altercation" is that a verbal altercation occurred that the police felt was about to turn physical and they intervened before it happened. Of course that's pure speculation on my part, but I think it sounds reasonable. I'm sure the details will come out in time, it's not that major and either way Nico will learn a valuable lesson early on.

Spoken like a true cop. This is a joke. Next time Coach Saban says to "lets go kick their @ss" in a pre-game press conference somebody should make sure to sign a warrant on him.

I did read the links, both of them.
The second makes it clear that Nico Johnson turned himself in.
It makes no allegations either way about the nature of the complainant's case.
The spokesman for the Andalusia Police Dept just said, if the complainant swears out a statement alleging the offense, then they have to issue the warrant.
Earle was getting onto people for spreading the (false) rumor that it was some kind of altercation with a police officer. Earle was correct to squash these type rumors, especially since the story denies that anything of that nature happened.
The story does not provide any details at all about what actually happened between Johnson and the complainant.
 
I've concluded that this topic can't be discussed intelligently. No matter how many times it's posted (and published) that Nico surrendered after hearing about the warrant, people jump in without reading the thread and start bashing the police, who basically had nothing to do with the whole incident. Whether or not they need bashing is totally irrelevant to this thread. Therefore...

Linebacker Nico Johnson's attorney: "This is a good kid. His family has done well with him. When I found out that somebody had made this allegation, I said, 'There must be some mistake. That just doesn't sound like Nico.'""I'm confident that he'll be exonerated, whether it's going to be a flat-out dismissal or a not-guilty (verdict)," Andalusia attorney John Jones said. Even if things don’t legally go his way next week, incoming freshman linebacker Nico Johnson will almost certainly be on the University of Alabama campus by the end of the month and enrolled for the first summer session.

Johnson is due to face “a verbal, non-physical” misdemeanor harassment charge Monday in Andalusia Municipal Court. He turned himself in to local police May 5 in response to an arrest warrant sworn out by a relative of a fellow Andalusia High School student (considered a minor).
