Man I hope not. Because that's not how it was explained when I first heard it being talked about.
Unfortunately, there's no "I hope not" regarding these situations when the playoff committee makes the decisions for the playoff. This is exactly how they will make their decisions. They have made it known that this is how they will handle injuries.

Again, politicians will be making this call and they all want one thing-to be re-elected. Prosecuting this case may be career suicide in Florida.
Politicians will be making the call but remember that there is more than one school in Florida so the question may be how influential is Florida State?

Some damming stuff:
* DNA match proves he was there and participated
* Girl filed rape charge immediately and never backed off.
* She could not identify the attacker initially, which makes the consensual sex defense harder to believe.
* Her physical descriptions were off, which makes the "she is trying to frame him" defense harder to believe. If she were trying to frame him she could look up the height and weight on the roster.
* All this happened before he was even a starter which makes the frame up defense harder to believe.
* The questionable handling by the local police even lends itself to them believing there is truth to the rape charge.

This REALLY looks bad for Winston.

I'm tired of people defending JW and saying, wait for the facts or he hasn't been charge yet. What about the victim folks, doesn't she deserve justice? This case makes me sick because there is clearly enough evidence to bring charges on JW but, because he's a FSU football star, the TPD have buried the case for months. If this was any of us, we would all have been arrested back in January, there's no doubt in my mind about that. I'm not upset with JW, he'll get his day in court to prove his innocence or guilt if justice is aloud to be served in this case. What I'm upset about is the cover up, a police department that decided a football season was more important then justice. There are folks in that department that need to lose there jobs and maybe even be prosecuted.

I'm not a big fan of the media these days but thank goodness for them in this case. Without them and the leaks, this case is probably still being buried by the TPD. I'm not saying JW is guilty, just that there has been enough evidence for charges to be filed for months and the fact that they haven't been, because he's a football player, is disgusting. It is mind boggling how screwed up priorities are in this country are that we are willing to let a potential victim suffer for months all for the sake of a crystal ball.

If Winston goes out, FSU is left with the #3 QB. Coker just had knee surgery and is done. With the #3 QB, does FSU stay at #2?

You're right. No one's ever been bought off. My apologies for the smarm. Yes, it amounts to extortion. I'd love Winston to press the issue.
See, that's the problem - Winston does not have enough money to "buy her off". It would either have to be paid by an agent immediately, or be a promised payment after he signs in the NFL. If an agent pays, that agent would be taking a huge chance - Winston is still 2 full years from being able to play in the NFL. Anything can happen in 2 years - especially if Winston is a person who is of this type of character. Also consider that the agent getting involved would be breaking several laws. Just not likely.

If the girl decides not to press charges for future payment, there could be no written agreement. That agreement would be illegal, and would not hold up in court. So she would just be trusting him to pay her years from now - the guy who raped her. Not Likely.

In other words, I don't see this as the typical "payoff" scenario. I think it goes to court.

The TPD is definitely looking very poor in all this. Ironically, in their attempt to cover it up or bury it for months, they actually delayed the case so much that if charges are filed, it likely won't be resolved in time for a bowl game. Had they done their job in January, JW may have been forced out of school for that semester, but there's a possibility the issue would be resolved in the summer and he could've been reinstated in time. If the Court system there is like it is here, then even filing a motion for speedy trial for someone (should he be charged and released on bond) is still a wait because (especially for felonies) those people in jail get preferential settings over those out on bond.

The way to do it would be to sue him for sexual assault and then settle out of court, with the settlement to be garnished from future earnings. Then she just refuses to prosecute, and he is golden.
Right, but she would have to refuse to prosecute now. The state is moving on this very aggressively now that they see the police "mistakes". She would look very, very bad if she did this now after the recent statements by her attorney.

Again, I just don't see it happening.

When you put it all together...it certainly doesn't look good. These last few days have changed my view on the situation considerably. It's getting worse and worse by the moment.

I know people who know him from home and they are all ADAMANT that he would never do something like this. So it truly is shocking to me, but the evidence is starting to overwhelm friends opinions of him.
Yeah, but many times we don't know people enough to know what they would do when put in a certain circumstance. I'm not saying Winston is guilty but it could be the reason those people say he would never do anything like that is because they never saw him under these circumstances.

No doubt. I agree. But even without drugs and/or alcohol you have some people who you'd never know were a certain way because you've never been around them when they were in a certain circumstance or environment.

Remember DNA only proves they had relations, not whether it was consensual or not.
I think some people took this as if I was saying it may have been consensual. I do not know, but you can rest assured the defense will paint it as a consensual act.

This is a lose/lose scenario for everyone involved. From what I understand she backed off, but when the media found out it was reopened and put in the hands of the state DA where it should have been sent months ago. Does she have to press charges in order for the crime to prosecuted?

FSU looks like a football factory at this point. Imagine sending your daughter to FSU when they possible conspire with local PD to conceal a rape. If he is not charged, public opinion is that he is guilty and if FSU continues to play him, they take a PR hit. JW's reputation has been damaged now and his worth as a football player or baseball player either is diminshed no matter how well he performs on the field. Zero winners in this situation outside of Waco Texas.

When asked about any blow back from the story, he said that he has received death threats, been called a Bama homer, a gator homer and even an Ohio State/Urban Meyer homer. He also said that more will be coming out over the next couple of days and it will be even bigger news.

There could be a wealthy booster willing to pay off these folks to try and make it go away. We don't know if he is guilty or not but things are looking worse for him now than they did just a couple days ago. I hope that all the facts come out and justice prevails in this one no matter what the outcome is.

B1G, couldn't it come from "family money" a la JFF? Assuming the family has money, of course...

Also, since he redshirted last year, do you mean that he would have to wait 1 more academic year before joining the NFL?

Who from? The TPD. They may have bungled the case, but I think it is a tough arguement to prove in court. JW has no money. You damage his ability to go pro with these acusations so he may not have any future earnings. A booster might pay them off, but as I understand it, the case is in the hands of the state attorney, not the victim or her family so what purpose would that serve. Maybe someone who has legal knowledge can shed some light.

The football part of the equation is interesting. Baylor is just sitting there at 3 with a great shot at a championship if JW get suspended. They still have to beat OSU, but who would have thought they would any shot at the title. If Baylor loses then OSU may or may not slip in against FSU. It is getting crazy.
