When I was a young pup, my generation made the argument that if we were old enough to die in 'Nam we were old enough to buy a beer. The argument got traction, and the drinking age was lowered to 18. Society reversed that decision a few years later, finding that just because you were old enough to die in "Nam did not mean you were old enough to make good decisions regarding alcohol.
Recent studies have shown that the emotional centers of the human brain develop more quickly than the higher centers that put brake on impulsive behaviors. This is why teens seem to take so many stupid chances, and why males in their teens and early 20s are actually the best group to send to war. The higher order centers do not develop fully until about the age of 25. So the car rental companies are really the only ones that get it right, since they do not consider you an "adult" until 25. Interestingly, they drew this conclusion based on actuarial data, and they hit it dead on when you compare it to the newer MRI and PET data.
We are going to keep seeing these things happen until we start limiting our recruitment to people 25 and older. It is a consequence of our biology.

There must be a rule of which I was unaware. If so, I am sorry.
If you think about it, a tendency towards risky behavior among young males was probably an advantageous trait evolutionarily. A young paleolithic male would be forced to make his own way in the world upon reaching maturity. In many cases, this probably meant leaving the tribal group, striking out on his own and trying to establish a new group in new lands. Those with a propensity to take risks probably succeeded. Those that did not take the risks probably hung around the tribe, never got to mate successfully and were eliminated from our gene pool.

CNS and society as a whole are fighting against hundreds of thousands of years of evolution when trying to get college aged kids to behave responsibly all the time.

I guess the next time you run a stop sign, you should be charged with murder since you could have killed someone had there been another car there. Punishing someone for what might have happened doesn't make any sense to me.
What about this then... What if someone intentionally leaves a poison laced cup of juice in the immediate area of a toddler? Should that person be charged? Or should that person only be charged if the child drinks the juice?
