You completely are missing the point or don't know how CNS's mind works. It very much matters to him if he has responsibilities that are tied to a contract. Let me say it again, HE IS THE ULTIMATE PROFESSIONAL! Byrne knew this and that is why he wanted to keep him on in some official capacity. Saban has a million and one things that he will completely wrap his time and life in through business ventures and whatnot, but if he has agreed to do something he is going to do it.
