I'll take your word for it. It's not like she's wrong, though. We decorate Christmas at our abode, but I honestly could give a damn what the WH looks like in December. 🤷‍♂️

It must be terribly frustrating to be in Berman's position. I'd have continued asking her the question she refused to answer. I'd call her out for spouting nonsense and I'd have trouble using those terms rather than words people can't say here or on news programs.
 
We do have tape of Hegseth saying that the 'rules of engagement' mean nothing to him and he will ignore them.
As SECDEF, he is really the guy that writes rules of engagement (or approves those written by theater commanders and sent to him for approval).
All he saying here, despite MSNBCNow's protests to the contrary, is that he will not approve "stupid" ones.
Let me give you an example. The US went into Haiti in September 1994 (I was there). Coming on the heals of the debacle in Somalia, the administration wanted to make sure we did not get involved in some Haitian-on-Haitian civil war ("After all Somalis are black, Haitians are black, so they're the same, right?") so the rules of engagement were that US forces were not to get involved in Haitian-on-Haitian violence.
A young soldier in the 10th Mountain Division was guarding the front entrance to the Port-au-Prince Airport. Some young pro-Arisitide Haitian came up to the American soldier celebrating the return of President Aristide. A FAd'H (Armed Forces of Haiti) soldier next to the American, who did not support Aristide or his return, took exception to the pro-Aristide Haitian's exuberance, so the FAd'H soldier beat the Haitian civilian to death right in front of the American soldier, who looked on in horror, but, following his ROE, did nothing to stop it. CNN cameras captured and broadcast the entire event.
The next day, the ROE was "amended" to allow defensive intervention to protect Haitians' lives.
That was a stupid ROE, approved by a ignorant cowardly SECDEF.
 
The next question should have been, "Is pardoning a drug trafficker self-defense to protect Americans in vital United States interests?"

The right continues to praise these bombings while remaining silent on the disgusting pardon Trump issued.
The retention of the royal pardon in our Constitution has always puzzled me. We fought a whole bloody war to get away from the like of it. If they wanted to retain it, they should have least made it over-ridable by Congress, either by majority of both houses or 2/3, if you like pardons...

It's puzzled me as well. All Biden has to do is say "Yes, I pardoned those individuals" (and the same with legislation). There are no limitations trammeling those powers in the constitution and any attempt by Congress to impose the same would be unconstitutional, IMO...

Having read a bit of the Founder's thinking, I would say that the Presidential pardon can only work in favor of the convicted, never to his detriment. (in other words, the president cannot overturn an acquittal.) It is just one last barrier between an accused individual and maliscious prosecution.
I do not imagine that the founders believed it would be used so pervasively and sold in such a corrupt fashion, although they should have. The entire English Whig tradition would've shown them that this was likely to happen. Any power that can be abused will be abused.
