This may or may not be the thread for this, but this scenario is illustrative of one of the reasons I would like to see a Constitutional amendment to mandate either a fixed term or a mandatory retirement age for SCOTUS justices.

And members of Congress. Age is relative and a number does not necessarily determine one's ability to comprehend and make an informed decision on issues that impact the country and its citizens, but IMO there should be term limits and/or mandatory age limits for all members of congress and SCOTUS justices. An arbitrary age would be 70 or 72, as for term limits 10 years to no more than 20 years for either congress or SCOTUS.

Now, what will be the effects of 4 to 4 votes? Does that mean the POTUS can do anything he wants to do since not much will happen in the SCOTUS until a new member is present. And will the Senate approve any nomination from the POTUS?

Also, if HRC is elected and an appointment has not been approved by January 20, 2017, will she nominate the One?

I think this is a very SAD day in the history of our country.

Thank God for Justice Scalia, may He hold his family in his hands through this loss and help our country find the right way in the coming elections and appointments.

No more than 2 terms for Senators so that would be 12 years and I agree with 10 years (5 terms, maybe 4 is enough) in the House.

There should be NO retirement plan for any politicians. You serve as a SERVANT of We the People, then return home to get a REAL job! They can receive Social Security just like anyone else. We have 300+ million people in the USA. I just know we have more than 435 + 100 people out of that 300+ million people who could SERVE We the People effectively, efficiently, and productively.

4-4 affirms, as a matter of law, the lower court decision, but makes no precedent. So really, not a lot changes. Take the Texas immigration case. The Fifth Circuit issued an injunction preventing Obama's immigration plan. The Supreme Court has to decide that. It would have been either 5-4 Obama or 5-4 America, with Kennedy deciding. If Kennedy goes conservative, 4-4, lower court affirmed, injunction stands. Only place that it really mattes is circuit splits.

I would like to offer my sincerest condolences to the Scalia family after the passing of Justice Scalia. Justice Scalia was a remarkable person and a brilliant Supreme Court Justice, one of the best of all time. His career was defined by his reverence for the Constitution and his legacy of protecting Americans’ most cherished freedoms. He was a Justice who did not believe in legislating from the bench and he is a person whom I held in the highest regard and will always greatly respect his intelligence and conviction to uphold the Constitution of our country. My thoughts and prayers are with his family during this time.

The Supreme Court deals with evil. They decided criminal cases, including some dealing with the most evil people on the planet. They make decisions about abortion, which both sides believe is a moral imperative. I don't liberal justices are evil. I think they are wrong, and in being wrong, the allow evil to happen.
you are implying that the selection of a justice which you don't agree with will lead to evil. your "side" is not inherently righteous and that implication rests on that premise.

I don't understand Bazza. He is saying Barack Obama would not be the best person to make this appointment and that it should be made with careful thought and consideration. Do you disagree?

1. The constitution gives the president the authority to nominate justices.
2. Barak Obama is currently the president.
3. Therefore, President Obama gets to nominate Scalia's successor.
