Nico Johnson arrested

Back in my youth, I got into a "discusion" with one of Birmingham's finest outside a Southside drinking establishment. I ended up forcefully expressing my opinion of his parentage and was promptly arrested. The charge was "Verbal Assault of a Police Officer", which tended to get shorted on credit reports and other official searchs as "Assault of a Police Officer". Cost me a couple jobs I thought I had after the interview.
 
Will you guys read the latest link? There was nothing involving Nico and the police at all. Another student got mad at him and swore out a warrant. The police know nothing about it, other than what the complaining party said about what happened. When someone like that comes in, the cops will "counsel" the warrant-seeker as to whether or not there's a case, and the consequences of a false warrant, but a stubborn person (or, probably, in this case, a kid with stubborn parents) can insist on his warrant and the police are duty-bound to carry it out.
 
Not saying I'd want to go 1 on 1 with Nico either, but sounds like someone can't handle their problems like a man. I know we don't know all the details and maybe there is something more to it, but a "non physical verbal altercation".....:rolleyes::rolleyes:

Don't cloud some of these posters thinking with fact, everyone knows its the police over-reacting when one of our players has an incident evolving an arrest.
 
How do you get arrested for a verbal, non-physical altercation?

I was arrested about a month before I went into the Navy for Yelling F-off when I got between a cousin and someone who was trying to start a fight with him. The police showed up and the guy said something to me as I was walking away as the police had ordered me to. It can happen.
 
I spent a night in the slammer for "simple assault to a police officer" back about 20 years ago. I don't recall if I went to jail for the cussing job I did on the officer or the public drunk charge. I just can't remember. I do remember that it got me 90 days suspened sentence and a $450 fine. All that because of a misunderstanding between me and the man.

My wife just reminded me that the resisting arrest charge didn't help either.
 
Unfortunatly most cops have the I am the tough guy man attitude and can/will arrest you for anything, I personally have no respect for them.
 
Folks, I've been a small town lawyer for nearly thirty years now. Although I don't do much criminal work nowadays, I did in the past. I can tell y'all that what Nico is charged with is among the most idiotic of "crimes" that is on the books. ANYONE can get arrested and convicted of harassment in Alabama for basically cussing someone else out.

For quite awhile, "harassment and harassing communication" has been a crime in Alabama, courtesy of the people we send to Montgomery to make our laws. Just as an FYI, here's a part of the law, from Section 13A-11-8 of the Code of Alabama:

A person commits the crime of harassment if, with intent to harass, annoy, or alarm another person, he or she either:

a. Strikes, shoves, kicks, or otherwise touches a person or subjects him or her to physical contact.

b. Directs abusive or obscene language or makes an obscene gesture towards another person.

You don't have to injure anyone and it's still a crime if you yell at your spouse in your living room. The moral of the story, I guess, is that we should all be nice or risk going to jail. :) :)
 
And once again I'm reminded of what a "police state" we live in these days. Never knew I could be arrested for flipping off some tool. Sheesh!
