He would most likely still go in the first round if he came out. Just a few years ago, Notre Dame linebacker Jaylon Smith was drafted 34th overall (2nd pick of the 2nd round) after completing tearing up his knee including nerve damage. There was the possibility that he would never regain his full athleticism back and he would definitely have to sit out a full year to rehab. He still went 34th overall. Just using that as an example and the fact that Dylan had a basic ACL tear and will be ready to play this fall, I feel pretty strongly that Dylan would still be a first round pick. Probably in the first half of the first round. All of that to say I'm not sure there's much to collect on in terms of loss of value but I'm not a lawyer either..
